Acceptance of these terms

Using this Website means you accept these terms. We may amend them at any time, and the date at the top of this page shows when they were last revised.

What this website says

The information here is general and is given in good faith. We work to keep it accurate and current, and we do not warrant that it is complete, free of error, or suited to your particular property. Descriptions of services and coverage areas are indicative and may change. Nothing on this Website is a binding offer to supply.

Quotes

Quoting is free and carries no obligation. A quote is based on what you tell us, on the plans or photographs you send, and where relevant on what we see on site. If the information we were given turns out to be incomplete, the price may change.

Where the work required differs from what was quoted, for example because of damage that only becomes visible once a lining comes off, we contact you to discuss it before going any further. A change to the scope may change the price and the finish date.

Access and site conditions

You are responsible for safe and reasonable access to the work area at the agreed time, and for telling us about any hazard or concealed service that may affect the work, including hidden electrical, plumbing and communications runs behind a lining.

Where the work is to an existing building, you confirm that you own it or have the owner's authority for the work to be carried out.

We sheet and set on a frame somebody else has built, and that frame has to be finished and true before we start. We do not carry out asbestos work of any kind. Where asbestos containing material is found, work stops until it has been dealt with by a licensed removalist.

Payment

Unless we have agreed otherwise in writing, payment is due on completion. Invoices are in Australian dollars and include GST where it applies.

Title to materials we supply stays with Newcastle Gyprocker Heroes Pty Ltd until we have been paid in full. Risk in those materials passes to you once they are installed.

Cancelling or rescheduling

Tell us as early as you can. A fee may apply where materials have already been ordered for your job, since board and compounds are ordered per job rather than held in stock.

Liability

To the extent the law permits, Newcastle Gyprocker Heroes Pty Ltd is not liable for indirect or consequential loss, including loss of income, loss of use or loss of opportunity, arising from our services or from your use of this Website.

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded, or any statutory right that applies to residential building work in New South Wales. Where our liability can be limited, it is limited, at our option, to resupplying the services or paying the cost of having them resupplied.

Governing law

These terms are governed by the laws of New South Wales, Australia. You and Newcastle Gyprocker Heroes Pty Ltd each submit to the non exclusive jurisdiction of the courts of that state.
